A Hastings man faces three counts of third degree sexual assault on a child.
27-year-old Abraham Lopez-Jose was booked into the Adams County Jail, and charged with the three felony counts.Police say he sexually assaulted a four-year-old boy, who is not related to him.
An affidavit filed with the court outlines the case:
Three children were being watched by a woman who went to the home of Abraham Lopez-Jose. The home is in the southeast part of Hastings. Lopez-Jose is not related to the children.
The woman took a nap, while Lopez-Jose was in the living room with the children.
The kids were watching Scooby-Doo when Lopez-Jose allegedly put in a pornographic video. Investigators said he fondled the boy and touched the other two on the outside of their clothes.
Abraham Lopez-Jose denied watching the video. Police searched the home, and found it in a stack of children’s DVDs.
Nebraska state law defines third degree sexual assault on a child as not causing serious personal injury to the victim. By definition, there is no sexual penetration in a case of third degree sexual assault.
