District Judge Travis O'Gorman rejected a motion to move Guy Eagle Elk's case to juvenile court. Eagle Elk is accused of aiding in the assault that killed Scotts Bluff County Corrections Officer Amanda Baker on Feb. 14. He has pleaded not guilty to the charges.
According to prosecutors Eagle Elk told a fellow inmate how to choke Baker into unconsciousness so he could steal her jail keys. Eagle Elk also allegedly encouraged the other inmate to carry out the attack.
The Lisco, Neb. teen said he didn't intend for the guard to be seriously hurt. He is scheduled for a July trial.
